Success Story: A longtime DACA recipient was granted renewal with DUI expungement
Our client, a longtime DACA recipient, made the unfortunate mistake of being arrested and charged with a DUI in Los Angeles, California. Following this, he was convicted of said crime.
He attempted to file his DACA renewal on his own. However, while the renewal was pending, he received a Notice of Intent to Deny (NOID) from USCIS. The NOID stated due to his prior DUI conviction, he was ineligible to renew his DACA, and USCIS gave him a tight deadline to submit evidence proving otherwise.
Therefore, he came to our office, and we immediately inquired whether he had expunged the matter, to which he replied yes, showing us proof of the expungement.
Following this, we prepared a detailed response to USCIS’ NOID with a cover letter arguing that he was entitled to have his DACA renewed from a discretionary standpoint since his DUI conviction was expunged. We also supplemented the record with proof of equities and his good moral character.
Following this, USCIS promptly responded by granting his DACA renewal. Our client was able to put this mistake behind him and continues to work in the US.
