A few weeks ago, an increase in absentia removal orders against immigrants was reported in the city of San Francisco, California. These are expedited orders given to people who did not show up for their hearings and are issued by judges when this happens.
Between August and September 2021, 173 immigrants received deportation orders in absentia, which is nine times more than the resulting figure between the months of January and July of the same year.
According to an article in The San Diego Union-Tribune, criticism of this practice has been raised by immigrant advocates because foreigners did not receive court notices to appear since they were returned and cataloged by the postal service as “undeliverable.”
However, these deportation orders are not always final and can be taken to court to “fight” them. However, the ideal action to take is that if this is your case, contact an immigration attorney as soon as possible to help you in the process and have a successful result.
An argument could be that you did not show up due to significant forces. However, if this is the case, you only have 180 days to file a claim.
