After extensive negotiations, investigation, and a carefully-crafted game plan, our client was able to have three convictions vacated and allowed to stay as a lawful permanent resident in the United States. This is one of our recent success stories
Our client, a long-time lawful permanent resident in removal proceedings had prior convictions on his record that made him deportable and inadmissible. They were violations of California Health and Safety Code (“H&S”) 11352 (Sale of a Controlled Substance) in 1990, H&S 11351.5 (Possession for Sale of Cocaine) in 1994, and H&S 11351 (Possession for Sale of a Controlled Substance) in 1997.
He would qualify for relief under INA 212(c) but for his 1997 conviction. Nonetheless, we carefully crafted a game plan to attack all three convictions to put our client in the best position possible as they were not only Crimes Involving Moral Turpitude but also Aggravated Felonies and deportable Controlled Substance offenses.
We researched both the underlying criminal and immigration laws today and also at the time of his convictions. Then, we executed a declaration whereby our client affirmed he was never properly advised of the immigration consequences of his guilty plea.
Next, we reached out to prior counsels on each case to do our due diligence. Finally, we were able to put together an extensive equity packet revealing how our client successfully turned his life around and became a hard-working, church-going family man.
After extensive negotiations with the prosecutors on the case, we successfully managed to have all three convictions vacated and had him enter a guilty plea nunc pro tunc to Penal Code 32 (Accessory After the Fact), which is neither a Crime Involving Moral Turpitude or an Aggravated Felony in the Ninth Circuit.
