There are many types of visas that allow someone to remain in the United States legally, and one of them is the K1 visa, also referred to as the fiancé visa.
The K1 allows the fiancé of a current US citizen to enter and remain on United States territory but under the condition that they get married within 90 days upon arrival. Then, the spouse may request a Green Card based on marriage.
Even if the name “fiancé” refers to a man, it applies to both men and women.
How to apply for the fiancé visa
To apply for a K1, or fiancé, visa the legal US resident must file a Form I-129F, Petition For Alien fiancé(e), which you can find on the USCIS (United States Citizenship and Immigration Services) website. This is the first step in the process which asks this authority to recognize the relationship between the two people as fiancés.
The USCIS may request additional evidence after receiving the form. Also, an interview will be scheduled to determine if the foreign fiancé may be accepted in the country or not. In this meeting, the fiancé will be asked several questions to determine if the couple is genuinely in love with each other and want to live together.
For this last reason, the interview will have many standard questions, but also several personal ones as well. Even if some of the questions may seem invasive, the answers you give may determine whether you get a visa or not.
Preparing for the K1 visa interview
For immigration purposes, it is not enough to be engaged to someone to prove that you are in love and want to be together for the rest of your lives. Since visa and marriage fraud are common in the United States, officers must check as much as possible that the relationship is bona fide.
One of the ways to do this is by questioning the relationship and therefore being convinced that the feelings are genuine and you intend to get married as soon as possible. In the fiancé interview, there are no right answers, but there are ways to be prepared for the questions that you might get asked.
If the fiancé who is requesting the visa has any children, it is advisable for them to also attend the interview. However, if in doubt, contact an immigration attorney who will help you prepare for this important moment in your life.
The interview format will also vary from embassy to embassy, but in general, the beneficiary will have to answer around 100 questions about themselves, the fiancé and the relationship. It should last around 15 and 20 minutes.
